Must companies already join forces to become a bidding consortium at the tender application stage or is it possible for qualified companies that have applied separately to join forces to become a bidding consortium after the bidders have been selected?

Bidding consortiums must already have been formed in order to submit a tender application. Competition and contract-award legislation does not permit bidders to join forces subsequently.

Clarification no 5 The awarding authority clarifies item III.2.3 no 2.1 (techn. efficiency) as follows. The awarding authority further wishes to clarify that the minimum requirement according to III.2.3, no 2.1 of the publication text is a minimum requirement in the spirit of VI.3 of the publication text. Late submission of the two references required under III.2.3 no 2.1 shall lead to the bidder/bidding consortium being disqualified.

Please let us know whether, under III.s.3, item 1.1, the figure of 25 million euros given in the total applies to both shell construction projects or whether each project must have a contract value of 25 million euros.
Answer Flughafen Berlin Schoenefeld 6.1
If the references required under III.2.3, item 1.1 are to be included in the assessment, evidence of a contract volume of >= 25 millions euros must be furnished in each case. Such evidence does not constitute a minimum requirement.
