FBS Clarification 2.1

In response to your enquiry, we would point out that the invitation to tender for the contract for the Installation of Telecommunication Systems and Active Networking Technology/Transmission Technology is a public tendering procedure with a prequalification competition.
No bidding documents are sent out to participants during the prequalification competition. All documents, proofs and information etc to be submitted with the application to participate are detailed in the official tender publication, a supplement to the Official Journal of the European Union.
Upon evaluation of the participation applications submitted, the bidding documents will be sent out to the selected bidders.

A bank reference regarding payment behaviour is required under III.2.2., as per 1.1. We would be grateful if you could let us know what type of information the bank should provide. In other words, exactly what evidence is required?

FBS Clarification 3.1

In reply to your above-mentioned enquiry, we can confirm that the bank reference required is the usual financial status report banks generally provide for such purposes. As described in the invitation to tender, the financial status report should include details of payment behaviour. Please see the wording of the invitation to tender for further details.

Will the tender also include operation of the telecommunication system and the active components for the contract period (36 months)?

In reply to your above-mentioned enquiry, we can confirm that operation for test purposes is planned for part of the contract period.

Under what conditions is it possible to submit a tender application on one’s own behalf and also as a subcontractor to another bidder?

FBS Clarification 5.1

In the opinion of the awarding authority, it is permissible, according to current relevant jurisdiction to their knowledge pronounced by the Brandenburg Procurement Chamber and by the Brandenburg Court of Appeal, for a bidder both to submit a tender application and to participate as a subcontractor in the tendering procedure of another bidder. In such a configuration, however, no anticompetitive price fixing or other anticompetitive arrangements may be made by the individual applicants/bidders/subcontractors. The awarding authority therefore reserves the right in the case of such configurations to investigate closely with regard to observance of the relevant legal regulations the question of any violations of competition law. Bidders wishing to apply as part of such a configuration are required to ensure that no anticompetitive agreements or other breaches occur in connection with the configuration taking part in the tendering procedure.
